The CPSC publishes voluntary Safety Barrier Guidelines for Residential Pools covering barrier height, gaps, gate self-closing and self-latching hardware, and latch placement — but the legally binding requirements come from your state and local code, which you must check.
The CPSC's guidelines are exactly that: guidelines, not a federal standard, and CPSC says so in the publication itself. They are still the best single reference for what a safe barrier looks like, and most adopted local codes track the same ideas: a barrier tall enough that a small child cannot climb it, no gaps a child can squeeze through, no footholds, and a gate that closes and latches on its own with the release out of a child's reach.
The figure most widely used, in the CPSC guidance and in the International Swimming Pool and Spa Code that many jurisdictions adopt, is a minimum 48-inch barrier height. Your jurisdiction may require more. Do not build to a number you read online, including this one — call your building department and get their written requirement before you buy materials.
Beyond pools, the safety items worth attention are gate hardware that actually works year round, avoiding horizontal rails on the outside face that make a fence climbable, and keeping furniture, planters and AC units away from the fence line where a child could use them as a step.
One honestly bad idea: relying on a fence alone. Layers matter — door alarms, a power safety cover, and supervision. The CPSC publication covers those layers too.
