Like-for-like replacement in an existing opening is treated more leniently in many places than enlarging an opening or adding a new one, and the residential code contains a specific allowance for replacement windows regarding emergency escape openings. Under the International Residential Code, replacement windows can be exempt from certain emergency escape and rescue opening requirements when the replacement is the manufacturer's largest standard unit that fits the existing frame or rough opening and is the same operating style or one that gives an equal or greater opening. Whether and how that applies to you depends on which code edition your jurisdiction adopted and how it amended it.
Enlarging an opening, cutting a new opening, or adding a basement egress window is structural work and is much more likely to require a permit and inspection. So is work in a designated historic district, where the review may govern materials and sightlines, not just safety.
Permits protect you at resale. Unpermitted structural window work can surface in a buyer's inspection or a title search and become your problem later.
